Welcome to Simian - Escape. Travel. Explore! These Terms and Conditions ("Terms") govern your use of our website and services. For the purpose of these Terms, "Simian" refers to Simian - Escape. Travel. Explore. By accessing or using our website, or by booking a tour with us, you agree to be bound by these Terms. Please read them carefully.
1. Booking & Payment
- Payment: All participants are expected to pay the full package amount before the trip departure date. Full payment must be completed 30 days prior to the tour start date. For domestic tours (India), a 50% advance is required to book seats.
- International Tours: A 70% advance amount is required to book seats.
- Excluded Charges: The tour price excludes:
- VISA charges for international tours.
- Tourism fees, city tax, or government tax.
- Peak season surcharges during festivals, events, or carnivals (communicated at confirmation).
- Porterage, tips, and items not explicitly listed as inclusions.
- Package Pricing: Simian is not obligated to provide a detailed cost breakdown used to determine package price.
- Final Terms: The itinerary provided to the client contains package-specific terms which are final and supersede general terms on this website.
2. Cancellation & Refunds
- Cancellation Policy: Submit cancellation requests in writing to reachsimian@gmail.com from your registered email.
- Refund Schedule:
- Before 30 days - 90% refund
- Within 21-29 days - 75% refund
- Within 15-19 days - 50% refund
- Within 14 days - No refund
- Train Tickets: Applicable railway cancellation charges also apply when included in the package.
- Third-Party Policies: Third-party (airlines, hotels, railways) terms and cancellation policies apply in addition to Simian's.
- Specific Policies: Some tours may have seasonal policies which will be shared at booking.
- Refund Processing: Eligible refunds are processed within 10-15 business days of final cancellation confirmation. No refunds are provided for any unused services, accommodations, or meal plans for any reason.
3. Traveler's Responsibilities & Conduct
- Acceptance of Terms: By booking any service, you confirm you have read and unconditionally agreed to these Terms.
- Health & Physical Fitness: Consult a medical professional for advice/vaccinations. Disclose any physical/mental disabilities or conditions for all travelers at booking; failure to do so may result in termination of your trip at your expense if it poses a risk to the group.
- Documentation: Carry originals and copies of all mandatory documents and submit an additional copy to Simian. Failure to do so releases Simian from related consequences.
- Luggage: Simian is not responsible for loss of luggage, documents, or personal items under any circumstances.
- Transport: Participants must travel together in the assigned vehicle as per the agreed plan. Where overnight travel is restricted, the final decision rests with Simian and the driver. Extra charges may apply for night travel.
- Respect Local Culture & Laws: You must comply with local laws and customs. Simian is not liable for consequences of non-compliance.
- Behavioral Conduct: Disruptive behavior impacting fellow travelers will not be tolerated. The tour manager may remove offenders from the group without refund and without further services.
- Public Feedback & Non-Disparagement: Share feedback privately at reachsimian@gmail.com. You agree not to publicly attack or criticize Simian, its employees, associates, or partners on public forums, social media, or review sites before, during, or after your trip. A breach may result in legal action with damages of at least INR 50,000 per breach.
4. Disclaimers and Limitation of Liability
- Property Services: We do not control third-party properties and are not responsible for their services, amenities, or inclusions. Check-in/out timings are per property policy. Raise issues directly with the property; we may help coordinate.
- Third-Party Services: We do not control airlines, hotels, restaurants, transport, or other facilities in the itinerary and are not responsible for their schedule/service changes.
- Adventure Activities: Complimentary activities may be canceled due to weather or factors beyond our control; no refunds apply.
- Liability: Simian is not liable for changes to transportation, sightseeing, or services due to factors beyond control (e.g., weather, roadblocks, traffic, force majeure), or for reductions due to late starts by guests. Trip cost is non-refundable and non-exchangeable in such cases.
5. General Terms
- Changes to Terms: We may modify these Terms at any time; changes are effective when posted on our website, in brochures, or communicated otherwise.
- Website Content: Images/media are for marketing only and do not guarantee identical experiences.
- Media Consent: By participating, you consent to photography/videography for social media marketing; your privacy and safety are respected.
- Intellectual Property: All website content and the business name "Simian - Escape. Travel. Explore." are our intellectual property.
- Governing Law & Jurisdiction: These Terms are governed by the laws of India; exclusive jurisdiction lies with courts located in Mumbai.
- Severability: If any provision is invalid or unenforceable, remaining provisions remain in effect.
- Use of Cookies: Our website may use cookies or tracking technologies in the future to enhance user experience and for marketing.
